Accountability for NIS STAMPEDE Begins

The public interest case of PATIENCE NONYE OMEZIE & KASIM TUNDE SULEIMAN Vs FEDERAL REPUBLIC OF NIGERIA has been filed at the Federal High Court, Abuja, FCT, Nigeria

The case challenges the immigration job interviews of March 15, 2014 across Nigeria in which 19 citizens including pregnant women died and many others injured in their bid to get recruited into the 4th Defendant - Nigerian Immigration Service.

We are hopeful that this legal action will send the right message to the authorities and the citizenry about accountability and the right value of lives of Nigerian citizens.

The case was prepared, and court hearings will be lead by a team of senior advocates of Nigeria - Funke Adekoya SAN, Jibrin Sam Okutepa SAN, Ikeazor Akaraiwe SAN and Spaces for Change.S4C's Victoria Ibezim-Ohaeri.

The plaintiffs claim as follows:

i.     A declaration that the defendants herein were negligent and acted callously, unconstitutionally and in total disregard to the sanctity of lives of over 520,000 Nigerians who were invited for job interview and or screening by the Nigerian Immigration Services, when they (the defendants) failed and or refused to make proper and or at all adequate provisions for the protection of lives of these Nigerians and in consequence thereof, over 19 of these Nigerians were killed in a stampede in various stadia across Nigeria including Abuja contrary to SS.17(2)(b), (3)(a) and 33(1) of the 1999 constitution as amended.

ii.     A declaration that the sum of N1,000.00 collected from all Nigerians who sought to be employed into the Nigerian Immigration Services at the instance and or direction of the defendants herein is not only unlawful and contrary to the public service Rules and Regulations, but it constitutes a breach of the constitutional and statutory duties the defendants owe Nigerians including the over 520,000 Nigerians who sought to be employed into the Nigerian Immigration Services.

iii.    A declaration that the 3rd defendant is not a fit and proper person to hold public office in Nigeria having regard to his callous statement that Nigerians who died and those who were injured during the stampede resulting from the job interview and exercises on 15/3/2014 were impatient and that they did not follow the laid down procedures spelt out for them before the exercise.

iv.    An order directing the defendants herein to account for and pay to all Nigerians who applied for and paid to be employed into the Nigerian Immigration Services as such payment is illegal, unconstitutional and contrary to public policy and good conscience.
